Indiana Beer Distributor Loses Legal Fight to Sell Spirits
Indiana's largest beer distributor, Monarch Beverage Company, lost a court battle against the state's Alcohol and Tobacco Commission seeking to sell spirits in addition to beer and wine. State law stipulates that wholesalers cannot have beer and spirits in the same house, which Monarch claims is in violation of the Equal Protection Clause. However, US District Court Judge Sarah Evans Barker ruled that Monarch failed to prove it was being treated differently from other beer distributors in the state, or that the law lacks a "rational relationship to the State's legitimate interests."
