Diageo and Tenn. Clash over Injunction in Storage Lawsuit

You may recall, Diageo filed a lawsuit against the Tennessee Alcoholic Beverage Commission (TABC) in March over the state's Storage Statute after TABC notified the company it was in violation of the statute for storing Tennessee-produced spirits in Kentucky. Since the initial complaint was filed, Diageo has been unable to obtain a standstill agreement with the TABC to hold off on enforcement of the statute until the case is over. As a result, Diageo has requested the court grant an injunction preventing the TABC from enforcing the statute. Although a ruling has not been handed down on the injunction, both sides have filed memorandums to support their arguments both for and against the motion.
