Louisville Distilling Co., maker of Angel's Envy Whiskey, has challenged the validity of the deceptive marketing suit filed against it in the form of a motion to dismiss. Plaintiff Mario Aliano's claims are "riddled with implausible and conclusory legal assertions that render the Complaint insufficient," says Louisville Distilling in a memorandum filed earlier this month.
